Considering

  • Article 11.3.2 of the 2020 Rotterdam Port By-Law, which provides the requirement that it is prohibited to communicate fare without a permit granted by the council, unless the transport takes place with a tugboat that assists on the arrival or departure of the sea-going vessel;
  • Article 11.1.3 paragraph 1 of the 2020 Rotterdam Port By-Law, which stipulates that the skipper of a vessel that is equipped and used for communication sailing:
    • Uses a vessel that meets the requirements for the category in question pursuant to Article 11.1.2, paragraph 1, and that is equipped with:
      • A declaration of soundness (as referred to in Article 11.1.2 (1)) or
      • A certificate of inspection (as referred to in Article 6 of the Inland Waterways Decree) and
      • In possession of a Major Navigation License (as referred to in Article 14 of the Inland Navigation Decree) and a basic maritime radio certificate.
  • Article 11.1.3 (2) of the 2020 Rotterdam Port By-Law , which stipulates that the skipper of a ship that is equipped and used for communication sailing, and which sails a petroleum port, uses a ship that also complies with the provisions of Article 5.8 of the Port By-Law
  • Article 14.1 of the 2020 Rotterdam Port By-Laws, which includes the obligation to comply with the rules of the Port By-Laws;
  • Article 1.9 of the 2020 Rotterdam Port By-Laws, in conjunction with the Rotterdam Mandate, Power of Attorney and Authorisation Decree 2021, under which permits/exemptions may be granted by the Harbour Master in mandate, on behalf of the Municipal Executive.

  1. The ship's hull, which consists entirely of non-flammable material;
  2. During the stay in the petroleumhavven, a maritime telephone system that is in operation, on which the relevant VHF port channel is continuously monitored; 
  3. An electrical installation that meets at least the requirements in accordance with Atex zone 2 of Directive 1999/92/EC;
  4. If present, a living space, wheelhouse, engine room or control room that offers sufficient protection against the ingress of dangerous gases and vapors; 
  5. If present, a heating, cooking or cooling appliance that runs on electricity or a flammable liquid with a flash point of 55 degrees Celsius or higher, or these appliances are switched off, and; 
  6. A shielded engine that cannot serve as an ignition source.
